This document sets out rules on copyright and intellectual property relating to materials made available by VirtualMasterplan and Wizmax Studio - including software, visualisations, graphics, logos and other elements (the “Materials”).
Using the Materials means you accept the conditions below.
If you do not agree with any provision, please stop using the Materials.
1. Copyright ownership
All Materials, including software, source code, user interfaces, graphic designs, 3D visualisations, models, textures, animations, texts, photos, videos, logos, trademarks and trade names, are the exclusive property of VirtualMasterplan and/or Wizmax Studio or entities with whom appropriate licence agreements have been concluded. They are protected by copyright, industrial property law and international conventions.
2. Prohibition on distribution and copying
Without prior written consent from VirtualMasterplan and/or Wizmax Studio, any distribution, copying, modification, reproduction, publication, transmission, sale, licensing, creation of derivative works or other use of the Materials - in whole or in part, for commercial or non-commercial purposes, including sharing with third parties via networks, the internet or physical media - is strictly prohibited.
3. Protection of logos and brand names
Logos, trade names, trademarks and other identifiers of VirtualMasterplan, Wizmax Studio and related brands are legally protected. Removing, modifying, distorting or using them in a misleading manner is prohibited. Any use requires express written consent.
4. Integrity of materials
Users must preserve the integrity of the Materials. Removing, hiding, altering or distorting copyright notices, trademarks, legal reservations or other proprietary markings is prohibited.
5. User licences
Licences to use the Materials are granted only under separate licence agreements specifying scope, duration and conditions. Without such an agreement, no rights are granted beyond permitted personal use where applicable law allows.
6. Liability and sanctions
Breach of these provisions may result in legal action, including claims for damages and injunctions, under Polish and international law. VirtualMasterplan and/or Wizmax Studio reserve the right to seek full compensation for harm arising from infringement.
7. Final provisions
Changes
VirtualMasterplan and/or Wizmax Studio may change the Materials and this document without prior notice. The current version is published on the website.
No warranty
Materials are provided “as is”, without express or implied warranties, including fitness for a particular purpose or non-infringement. VirtualMasterplan and/or Wizmax Studio are not liable for damage arising from use or inability to use the Materials.
Force majeure
No liability for failure to perform obligations caused by independent circumstances - including natural disasters, war, IT system failures, government action or other force majeure events.
Entire agreement
This document constitutes the entire agreement on copyright and intellectual property, replacing prior oral or written arrangements in this respect.
Dispute resolution
Disputes arising from this document shall be resolved by courts competent for the seat of VirtualMasterplan and/or Wizmax Studio, under Polish law.
